Apparently the Ninth Circuit would beg to differ.

If the State (i.e. the citizenry) thinks that is in the general interest or the right thing to incarcerate certain people and restrict their freedom (which I think it is), the State also has the responsibility to do so in a way that is humane, and not cruel and unusual. California has not been fulfilling that responsibility.

We need to reexamine our sentencing guidelines in order to ensure that only dangerous criminals are incarcerated and furthermore that our prison system doesn't create criminals.

These things happen in prisons Anthony. Funds are short, programs are being curtailed and eliminated, and tempers are flaring. Remember these are not, for the most part...nice people. Many of them were assaultive on the street, and few of them change with incarceration.

As for that medical care everyone is crying about? It's not what Donald Trump probably gets, but it is adequate. Inmates can usually get to a clinic on 24 hours notice...immediately in emergencies. They can't get many of the drugs they want to abuse, and that has fueled a lot of the complaints. I'm here to tell you...in major emergencies these guys are life flighted to outside trauma centers at over $10,000 a flight in helicoptors to some of the best physicians in the nation.

Don't believe everything the prisoner's rights groups put out Anthony. Visit a local prison. Talk to the medical staff, some of the officers. Read something other than what the PLO or The Union puts out.

You'll have a broader...and more accurate...perspective.
