As a feminist, after reading this article, I wonder if there is a way to get Sam Schulman to also file an affidavit in the 9th Circuit Court proceedings? The 9th Circuit appears to be a rigged game against Prop 8, as was the California State Supreme Court and Appeals Court, but Schulman’s feminist approach should be in the permanent record so when this gets to the U.S. Supreme Court, which it surely will, it is contained in the record.

This “unconventional” argument is, by far, the most profoundly persuasive I have read on the topic of same-sex marriage. And I was glad to see incorporated within it Sam Shulman’s quintessential essay on the subject.

We’ve seen it time and time again, that what appears to be “progressive” is inevitably “backward.” You’d think we’d learn! But today (as in 1856), the only truly “progressive” option is conventional marriage.
