If private parties are the only non-exempt parties, I guess I won’t be buying defaulted mortgages in CA anymore. The purpose of dual-tracking is to give borrowers an incentive to come to the bargaining table. If that’s not possible, I wouldn’t bother trying to make a deal that gives the borrower more than they’d get if I just foreclose, I’m just going to foreclose. I doubt that’s what the authors of this law intend.

Also note a no doubt intended consequence. When financing is tight (like today) owner financing and non-bank lending becomes more commonplace. By screwing private parties but not the major banks and Fannie/Freddie, this law would tend to suppress such competition to the banking system.

And that $26 billion legal settlement-where did THAT $$$ go??? Into the general fund, not to homeowners scammed. And where does it go after the general fund?? Into the pockets of the public employees-so the trough feeders were the beneficiaries of the lending scams, not the homeowners duped and defrauded.
