					<description><![CDATA[If private parties are the only non-exempt parties, I guess I won&#039;t be buying defaulted mortgages in CA anymore. The purpose of dual-tracking is to give borrowers an incentive to come to the bargaining table. If that&#039;s not possible, I wouldn&#039;t bother trying to make a deal that gives the borrower more than they&#039;d get if I just foreclose, I&#039;m just going to foreclose. I doubt that&#039;s what the authors of this law intend.

Also note a no doubt intended consequence. When financing is tight (like today) owner financing and non-bank lending becomes more commonplace. By screwing private parties but not the major banks and Fannie/Freddie, this law would tend to suppress such competition to the banking system.]]></description>
