However, the real question was the apparent forced sequestration of the phone owners in their homes for hours until a warrant could be secured.  That is a no-no. 					<description><![CDATA[The use of a search warrant to seize the cellphone likely violated federal law (42 USC 2000aa).  In the 911 tape, the lady clearly tells the operator that she intends to send the video to the news media, meeting the work product definition of the statute as material intended for dissemination to the public.  The Sheriff’s Office must subpoena the video, which also means that the owner would keep possession of a copy - which could then be sent to the media.

They are a public menace. When will the complacent and self absorbed  public wake up and put a stop to this kind of abuse? That&#039;s obviously a rhetorical question. 					<description><![CDATA[As much as I try to take the side of the police, this is one of many instances they need to be smacked down.  Then there were the 2 ladies who were shot up by idiot cops looking for Dorner.  
Cops across the country are horrified of those cell phones.  Many states still try to make it illegal to video tape a cop on the job, no matter how many times courts defend it.  
The street law says it ain&#039;t illegal till you get caught.  And prosecuted and imprisoned.  Possession is nine tenths of the law.  The cops got the phones now and I imagine the videos will be somehow &#039;damaged beyond use&#039;.  
Part of the problem is the police unions.  It is nearly impossible to fire a public worker of any type and their unions have amassed huge amounts of money to hire armies of lawyers.   
The city will have to settle.  The police and afford to litigate but the city can&#039;t.  There will be no charges because the videos will end up being &#039;unusable&#039;, but there are still people who saw the attack and the city will be forced to pay idiotic amounts to the family.  The cops will get off, scot free.
