					<description><![CDATA[Would a bank approve a loan on a building before essential requirements for construction are determined like location, environmental impacts, access to power, etc.?  Judge Robie substituting Stuart Flashman&#039;s analogy to Apollo 11 with a water project doesn&#039;t exactly flow with the argument.  The high speed rail like Apollo requires engineering expertise for infrastructure, power sources, back-up systems, routing configurations and timing above and beyond the movement of water. As Flashman stated, the issue is about the integrity of the project. Proceeding without proper preparation is not in California&#039;s best interest.
The vision of the state is to assure Governor Brown has a legacy and various special interests are guaranteed funding at taxpayers&#039; expense. It&#039;s no longer a &quot;can do&quot; spirit, but a &quot;can get&quot; expectation of oligarchs.]]></description>

Last time I checked it was the COURTS that determined what was legal. I guess Marbury v Madison has been overturned by the CA 3DCA.]]></description>
