Cheering on judicial activism for a positive right such as public education may embolden the left wing, whose true goal for public education is probably to overturn Millikan vs. Bradley first (erase school district boundaries) and then Pierce vs. Society of Sisters (constrain or reduce parents&#039; rights to direct their own children&#039;s educations). All in the name of Disparate Impact. The best approach to these legislative protections for teacher tenure would have been in the legislature and the ballot box. However distant of difficult that may have seemed, it was worth fighting for. Now all the kept legislators of CFT and CTA can continue to cash their campaign checks, blame the judge and plead not-guilty to both their union bosses and their constituents.  Oh, and abolish truancy laws, but that&#039;s another story.]]></description>
