Court rules that municipal water agencies in California must price tiered water rate blocks absolutely in compliance with 1996&#039;s Prop. 218. The price paid for any volume of water must be no more than its actual costs using American Water Works Association Water Utility Cost of Service and Rate Design Manual procedures. Ruled that San Juan Capistrano violated Prop. 18 when it arbitrarily set its water rates in an inclined block structure with the final block exceeding $9.00 per 100 CF. The city must revise its rates to follow actual costs incurred in producing and delivering water to customers.
