Are tech firms favored on concealed weapon permits in Santa Clara County?

Allegations that Santa Clara County Sheriff Laurie Smith and some of her top brass traded concealed weapons permits to a private company protecting top Facebook officials in return for a large campaign donation have dogged Smith since July and August, when the Santa Clara District Attorney’s Office began serving search warrants on homes of top department officials and searched the sheriff’s headquarters.

The primary focus of DA investigators – at least publicly – has been a $45,000 donation from Martin Nielsen, the leader of the AS Solution private protection firm, to the Santa Clara County Public Safety Alliance, a political action committee that backed Sheriff Smith in the 2018 election cycle and helped her win a sixth term. AS Solution operatives subsequently got several permits.

In September, San Jose Inside – the online website that broke the story of the probe in August – and other outlets reported that in 2018, there had been a deposit of $70,000 into Nielsen’s Citibank account just before he made the donation to the pro-Smith PAC. That raises the prospect of someone or some organization trying to launder campaign contributions, which is a violation of state law. San Jose Inside also reported last month that Santa Clara County Undersheriff Rick Sung had his home raided and some electronics confiscated by the DA’s office.

Report faults lack of standards on permits

Meanwhile, the San Jose Mercury-News reported last week that four Apple security executives had obtained concealed weapon permits. Last month, the newspaper reported that a review of permit records it obtained from the Santa Clara Sheriff’s Department showed apparent favoritism toward well-connected applicants and a lack of guidelines on when the permits should be issued. The report quoted a law enforcement official as saying permit decisions were based solely on the views of Smith – the first woman county sheriff in California history – and her top aides. 

But as a 2017 report by state Auditor Elaine Howle suggested, controversies like the current one in Santa Clara are close to inevitable because a century-old state law gives extraordinary discretion to county sheriffs and police chiefs in deciding which civilians get to carry a gun as they got about their lives.

The law says those applying for permits must demonstrate a “good cause” for a concealed weapon, must have “good moral character” and must complete a weapons-safety training course.

According to the San Francisco Chronicle, this flexibility has led to the issuing of zero concealed weapons permits in San Francisco, with a population of nearly 900,000, and to 2,300 winning approval in Solano County, with half the number of residents.

The state auditor wrote in 2017 that there was nothing inherently wrong with local governments having different standards and that she found no evidence of wrongdoing in the awarding of permits in Los Angeles, Sacramento and San Diego counties, which were the focus of her review.

But that hasn’t stopped years of headlines and letters to the editor questioning sheriffs and police chiefs for their decisions on permits and their lack of transparency on the topic. Many agencies take a year or more in responding to requests for related public documents.

Meanwhile, prosecutors face roadblocks in proving that campaign donations are the equivalent of bribes, especially in cases that are years old. The case of former Orange County Sheriff Mike Carona illustrates this. In 2005, the Los Angeles Times reported that Carona – first elected in 1998 – had issued 86 badges to his early political supporters that allowed them to carry concealed weapons. In 2007, former Assistant Sheriff John Haidl testified in Carona’s criminal trial that the badge program was explicitly created to boost Carona’s political war chest. The case presented by prosecutors included recordings of three conversations between Carona and Haidl in which Haidl wore a wire. The men talked about how to coordinate their stories to obstruct the federal probe of the badge program. 

But in 2009, a jury found Carona guilty of only one felony count of witness tampering. Carona’s lawyers targeted the credibility of Haidl – a Newport Beach businessman with no law enforcement experience – and argued that the statute of limitations had expired on most of the charges against the former sheriff.

Carona was sentenced to five and a half years in a federal prison.

Police were called to the site by a witness, but Gray was then pronounced dead upon arrival to the nearest hospital. The witness reported that the attacker had fled on a silver BMX bike.     Santa Barbara, California Homeless man found unconscious near Granny’s field Sept. 16th: Richard Alden Boden, a 51-year-old homeless man was murdered by three suspects and left for dead at Granny’s field. The victim was found in the middle of the field nonresponsive and was taken to the hospital for treatment. He was in a coma for weeks however, before being taken off life support by his family. Suspects Roman Romero, 18, Jonathan Andrade, 20, and Carlos Medina, 44, faced murder charges and conspiracy. They were taken to Santa Barbara County Jail with bail set at $1 million. Clearwater, Florida Homeless man murdered by gas station Sept. 16th: John Austin Lloyd, a 61-year-old homeless man was found dead outside a gas station in Clearwater. Police found that 32-year-old Myron Farley, who was charged in another shooting in Tarpon Springs could be a suspect. After a thorough investigation, police recovered two shell casings near Lloyd’s body that matched those from the Tarpon crime scene. A 9mm gun was found at Farley’s residence.

Torture charges were dismissed after Dorsette’s attorney, Michael Ewing, argued that “the state of torture statute pertains to actions that lead to intentional suffering.” The prosecutor plans to have the torture charges reinstated. Santa Ana, California Police officer shot and killed homeless man Jul. 30th: Hans Kevin Arellano, a 22-year-old homeless man, was shot to death by a female police officer outside a shopping center. Arellano was asked to get on the ground while in a restaurant. After exiting the restaurant, he was asked again to get on the ground. He did not comply, said some profane words, and was shot by the officer. A nearby eyewitness was able to capture the attack on his cell phone

Hoboken, New Jersey A homeless man died after landing on a fence Sept. 10th: Eric Ralph Santiago, a 46-year-old homeless man, was attacked by two 13-year-old boys and one 14-year-old boy. They punched Santiago in the face, causing him to fall onto a fence, leading to his death. The suspects were at first unknown. However, after police released the video images and surveillance to the media, the three suspects turned themselves in. They claimed they were playing the “knockout” game. After being punched in the face, “Santiago fell back from the blow and collapsed onto an iron fence, where he died after his neck was wedged between two posts.” The suspects were arrested and face murder charges

He did not comply, said some profane words, and was shot by the officer. A nearby eyewitness was able to capture the attack on his cell phone.     Suspects Emilio Arenas, 43, Peyton Hemingway, 37, and Theresa Allen, 46, were charged with multiple charges including, first-degree kidnapping, murder National Coalition for the Homeless Vulnerable to Hate: Hate Crimes against the Homeless 12 and robbery with deadly weapon, and conspiracy to commit robbery, murder and kidnapping. Hoboken, New Jersey A homeless man died after landing on a fence Sept. 10th: Eric Ralph Santiago, a 46-year-old homeless man, was attacked by two 13-year-old boys and one 14-year-old boy. They punched Santiago in the face, causing him to fall onto a fence, leading to his death. The suspects were at first unknown. However, after police released the video images and surveillance to the media, the three suspects turned themselves in. They claimed they were playing the “knockout” game.     Thank you, California. Thanks for showing that it’s possible to govern a large, complex, multi-faceted state with compassion and intelligence. Thanks for showing us that it’s not necessary to vilify brown people and blame them for all of the problems facing us. Thanks for showing that even though there are great challenges that we all face, that rabid, fearful, and inhumane treatment is not required to face those challenges. Also, thanks very much for taking a different path than the Democratic position has been over the last few decades, which has consisted of attempting to remain above the fray, the higher moral ground, and then losing when the opposition resorts to outrageous tactics. Thanks for fighting, and showing us that fighting is something you just have do sometimes.

    Homeless man driven over repeatedly Apr. 19th: Several people witnessed the deliberate acts of an individual with a car repeatedly running over a sleeping homeless man. The police concluded that it was not a hit and run, but rather that the killing was intentional. No arrests have been made. Las Vegas, Nevada Homeless man killed at his sleeping site May 11th: Ronald Gray, a 62-year-old homeless man was resting in an alley when he was stabbed to death by a man between the ages of 20 and25. Police were called to the site by a witness, but Gray was then pronounced dead upon arrival to the nearest hospital. The witness reported that the attacker had fled on a silver BMX bike. No arrests have been made. New Port Richey, Florida Homeless man died following a brutal attack by three teenagers Jun. 26th: Frank Rudolph, a 54-year-old homeless man was attacked by three teenagers on the intersection of Kentucky Avenue and Congress Street. The suspects beat Rudolph with sticks and their fists, leading to Rudolph’s death four days later at North Bay Hospital. The victim suffered injuries to his collarbone and blunt force trauma was deemed the cause of death. Allan Youngerman, 16, and a 15-year-old boy have been charged with his death. They were both known by police personnel for getting into trouble in the past. Doylestown, Pennsylvania Homeless veteran stabbed over 70 times Jul. 3rd: George Mohr, a 71-year-old homeless veteran was found lying in the street bleeding and unconscious after being stabbed more than 70 times by 21-year-old Dale Wakefield. He was charged with stabbing Mohr “in the head, chest, arms, hands, and back several times and beating him, causing multiple fractures and brain injury.” Mohr was transported to Temple University Hospital, where he was in critical condition until he died several days later. The suspect faced charges of first-degree murder and aggravated assault. and was held without bail. He pleaded guilty and was convicted to life in prison without the possibility of parole. Fresno, California Two homeless men shot at homeless camp, one killed Jul. 5th: Jordan Mullin, 20, and Manuel Galindo, 38, were shot at by three men near a homeless camp on Santa Clara Street. Galindo received injuries to his shoulder, while Mullin died after being shot in the head at his tent. Galindo was taken to Community Regional Medical Center for treatment. Police captured the two suspects, Raymond Snowden, 35, and Randy Little, 52. “Snowden is being charged with murder, assault with a deadly weapon and felony for possession of a firearm.
